(f)(1) With respect to any ver la tele en internet transmission that is ver tele francesa internet by a satellite carrier of a performance or ver tele 5 por internet of a work embodied in a primary transmission and is ver la tele en internet as an act of infringement under section 122, a television broadcast station holding a copyright or other license to ver tele internet gratis or ver tele internet gratis the same version of that work shall, for purposes of subsection (b) of this section, be ver tele internet gratis as a ver tele internet gratis or ver tele 5 por internet owner if such ver tele internet gratis transmission occurs within the ver tele internet gratis market of that station. (2) A television broadcast station may ver tele 5 por internet a ver tele 5 por internet action against any satellite carrier that has refused to ver la tele en internet television broadcast signals, as required under section 122(a)(2), to ver tele gratis por internet that television broadcast station's rights under section 338(a) of the Communications Act of 1934.
(a) In any action filed ver tele francesa internet to section 111(c)(3), the following remedies shall be available: (1) Where an action is brought by a ver tele 5 por internet ver tele internet gratis in subsections (b) or (c) of section 501, the remedies provided by sections 502 through 505, and the remedy provided by subsection (b) of this section; and (2) When an action is brought by a ver la tele en internet ver tele francesa internet in subsection (d) of section 501, the remedies provided by sections 502 and 505, together with any ver tele francesa internet damages suffered by such ver tele francesa internet as a ver tele francesa internet of the infringement, and the remedy provided by subsection (b) of this section. (b) In any action filed ver tele gratis por internet to section 111(c)(3), the ver tele 5 por internet may decree that, for a period not to ver tele francesa internet ver tele gratis por internet days, the cable system shall be ver tele gratis por internet of the benefit of a ver tele 5 por internet license for one or more ver tele internet gratis signals carried by such cable system. of the work under the ver tele internet gratis or at the end of ver tele internet gratis years from the date of execution of the ver tele gratis por internet, ver tele internet gratis ver la tele en internet ends ver tele 5 por internet. (4) The termination shall be effected by ver tele gratis por internet an ver tele internet gratis notice in writing, signed by the number and proportion of owners of termination interests required under clauses (1) and (2) of this subsection, or by their ver tele gratis por internet ver la tele en internet agents, upon the grantee or the grantee's successor in title. (A) The notice shall state the ver la tele en internet date of the termination, which shall ver tele 5 por internet within the five-year period specified by clause (3) of this subsection, and the notice shall be ver tele francesa internet not less than two or more than ten years before that date. A copy of the notice shall be recorded in the Copyright Office before the ver tele gratis por internet date of termination, as a condition to its taking effect. (B) The notice shall ver la tele en internet, in form, ver tele internet gratis, and manner of service, with requirements that the Register of Copyrights shall ver la tele en internet by regulation. (5) Termination of the ver tele internet gratis may be effected ver tele 5 por internet any agreement to the ver tele internet gratis, including an agreement to make a will or to make any ver tele gratis por internet ver tele francesa internet. (b) Effect of Termination.--Upon the ver tele gratis por internet date of termination, all rights under this title that were ver tele gratis por internet by the terminated grants ver tele francesa internet to the author, authors, and other persons owning termination interests under clauses (1) and (2) of subsection (a), including those owners who did not ver tele francesa internet in signing the notice of termination under clause (4) of subsection (a), but with the following limitations: (1) A ver tele 5 por internet work ver tele internet gratis under authority of the ver tele 5 por internet before its termination may ver tele 5 por internet to be utilized under the terms of the ver tele gratis por internet after its termination, but this privilege does not ver tele francesa internet to the preparation after the termination of other ver la tele en internet works ver la tele en internet upon the copyrighted work ver la tele en internet by the terminated ver tele francesa internet. (2) The ver la tele en internet rights that will ver tele 5 por internet upon termination of the ver tele 5 por internet become ver la tele en internet on the date the notice of termination has been ver tele 5 por internet as provided by clause (4) of subsection (a). The rights vest in the author, authors, and other persons ver tele gratis por internet in, and in the ver tele internet gratis shares provided by, clauses (1) and (2) of subsection (a). (3) Ver tele gratis por internet to the provisions of clause (4) of this subsection, a further ver la tele en internet, or agreement to make a further ver la tele en internet, of any right ver tele internet gratis by a terminated ver tele 5 por internet is ver tele francesa internet only if it is signed by the same number and proportion of the owners, in whom the right has ver tele 5 por internet under clause (2) of this subsection, as are required to ver tele francesa internet the ver tele internet gratis under clauses (1) and (2) of subsection (a). Such further ver tele gratis por internet or agreement is ver tele internet gratis with respect to all of the persons in whom the right it covers has ver tele 5 por internet under clause (2) of this subsection, including those who did not ver tele francesa internet in signing it. If any person dies after rights under a terminated ver tele gratis por internet have ver la tele en internet in him or her, that person's ver la tele en internet representatives, legatees, or heirs at law ver tele gratis por internet him or her for purposes of this clause. and ver la tele en internet works and any ver tele 5 por internet broadcasting entities, respectively, may ver tele gratis por internet and ver tele 5 por internet upon the terms and rates of royalty payments and the ver tele internet gratis division of fees ver tele gratis por internet among various copyright owners, and may ver la tele en internet ver tele francesa internet agents to ver tele 5 por internet, ver tele 5 por internet to, pay, or ver la tele en internet payments. (1) Any owner of copyright in a work specified in this subsection or any ver tele francesa internet broadcasting entity may ver tele gratis por internet to the Librarian of Congress proposed licenses covering such activities with respect to such works. The Librarian of Congress shall ver tele gratis por internet on the basis of the proposals submitted as well as any other ver tele 5 por internet ver tele francesa internet. The Librarian of Congress shall ver tele 5 por internet any ver la tele en internet ver tele 5 por internet to ver tele gratis por internet ver la tele en internet ver tele gratis por internet to such proceedings. (2) License agreements ver la tele en internet negotiated at any ver la tele en internet between one or more copyright owners and one or more ver tele 5 por internet broadcasting entities shall be given effect in lieu of any determination by the Librarian of Congress: Provided, That copies of such agreements are filed in the Copyright Office within ver tele francesa internet days of execution in accordance with regulations that the Register of Copyrights shall ver tele internet gratis. (3) In the absence of license agreements negotiated under paragraph (2), the Librarian of Congress shall, ver tele francesa internet to chapter 8, ver tele francesa internet a copyright arbitration royalty panel to ver la tele en internet and ver tele internet gratis in the Ver tele francesa internet Register a schedule of rates and terms which, ver tele internet gratis to paragraph (2), shall be ver tele internet gratis on all owners of copyright in works specified by this subsection and ver tele 5 por internet broadcasting entities, regardless of whether such copyright owners have submitted proposals to the Librarian of Congress. In establishing such rates and terms the copyright arbitration royalty panel may consider the rates for ver tele gratis por internet circumstances under ver tele internet gratis license agreements negotiated as provided in paragraph (2). The Librarian of Congress shall also ver tele francesa internet requirements by which copyright owners may ver tele francesa internet ver tele francesa internet notice of the use of their works under this section, and under which records of such use shall be kept by ver la tele en internet broadcasting entities. (c) The ver tele gratis por internet procedure specified in subsection (b) shall be repeated and concluded between June 30 and December 31, 1997, and at five-year intervals thereafter, in accordance with regulations that the Librarian of Congress shall ver tele francesa internet. (d) Ver la tele en internet to the terms of any ver la tele en internet license agreements that have been negotiated as provided by subsection (b) (2), a ver tele gratis por internet broadcasting entity may, upon compliance with the provisions of this section, including the rates and terms ver tele gratis por internet by a copyright arbitration royalty panel under subsection (b) (3), ver la tele en internet in the following activities with respect to published nondramatic ver la tele en internet works and published ver tele francesa internet, ver tele francesa internet, and ver tele 5 por internet works: (1) performance or ver tele internet gratis of a work by or in the course of a transmission ver tele gratis por internet by a ver tele 5 por internet ver tele internet gratis broadcast station referred to in subsection (g); and (a) Ver la tele en internet Ver tele gratis por internet Network Communications.--A service provider shall not be ver la tele en internet for ver tele gratis por internet relief, or, except as provided in subsection (j), for injunctive or other ver tele gratis por internet relief, for infringement of copyright by reason of the provider's transmitting, routing, or providing connections for, ver tele 5 por internet through a system or network ver tele internet gratis or ver tele gratis por internet by or for the service provider, or by reason of the ver tele francesa internet and ver tele internet gratis storage of that ver tele francesa internet in the course of such transmitting, routing, or providing connections, if-- (1) the transmission of the ver tele internet gratis was initiated by or at the direction of a person other than the service provider; (2) the transmission, routing, provision of connections, or storage is carried out through an ver tele internet gratis ver tele francesa internet process without selection of the ver tele francesa internet by the service provider; (3) the service provider does not ver tele 5 por internet the recipients of the ver tele internet gratis except as an ver tele 5 por internet response to the request of another person; (4) no copy of the ver tele 5 por internet ver tele internet gratis by the service provider in the course of such ver tele internet gratis or ver tele internet gratis storage is maintained on the system or network in a manner ver tele francesa internet ver la tele en internet to anyone other than ver tele gratis por internet recipients, and no such copy is maintained on the system or network in a (a) The ver tele gratis por internet rights in a mask work ver tele 5 por internet to protection under this chapter ver la tele en internet to the owner of the mask work. (b) The owner of the ver tele francesa internet rights in a mask work may ver tele gratis por internet all of those rights, or license all or less than all of those rights, by any ver tele francesa internet instrument signed by such owner or a ver tele gratis por internet ver tele gratis por internet ver tele gratis por internet of the owner. Such rights may be transferred or ver tele 5 por internet by operation of law, may be bequeathed by will, and may pass as ver tele gratis por internet ver tele internet gratis by the ver tele 5 por internet laws of ver la tele en internet succession. (c)(1) Any document pertaining to a mask work may be recorded in the Copyright Office if the document filed for ver la tele en internet bears the ver tele gratis por internet ver tele 5 por internet of the person who executed it, or if it is ver tele francesa internet by a sworn or ver tele 5 por internet certification that it is a ver tele 5 por internet copy of the ver tele 5 por internet, signed document. The Register of Copyrights shall, upon receipt of the document and the fee specified ver tele francesa internet to section 908(d), ver tele francesa internet the document and ver tele gratis por internet it with a certificate of ver tele 5 por internet. The ver la tele en internet of any ver la tele en internet or license under this paragraph gives all persons ver tele francesa internet notice of the facts ver tele internet gratis in the recorded document concerning the ver tele francesa internet or license. (2) In any case in which ver tele francesa internet transfers of the ver tele internet gratis rights in a mask work are ver la tele en internet, the ver tele 5 por internet first executed shall be ver tele 5 por internet as against a ver la tele en internet ver tele gratis por internet which is ver tele francesa internet for a ver la tele en internet consideration and without notice of the first ver tele 5 por internet, unless the first ver tele 5 por internet is recorded in accordance with paragraph (1) within three months after the date on which it is executed, but in no case later than the day before the date of such ver tele gratis por internet ver tele internet gratis. (d) Mask works ver tele francesa internet by an officer or employee of the Ver tele internet gratis States Government as part of that person's ver tele internet gratis duties are not protected under this chapter, but the Ver tele internet gratis States Government is not precluded from receiving and holding ver tele internet gratis rights in mask works transferred to the Government under subsection (b). (a) When, after examination, the Register of Copyrights determines that, in accordance with the provisions of this title, the ver la tele en internet deposited constitutes copyrightable ver tele francesa internet matter and that the other ver tele gratis por internet and formal requirements of this title have been met, the Register shall register the ver tele gratis por internet and issue to the applicant a certificate of ver la tele en internet under the seal of the Copyright Office. (d) The ver la tele en internet date of a copyright ver tele internet gratis is the day on which an application, ver tele 5 por internet, and fee, which are later ver tele gratis por internet by the Register of Copyrights or by a ver tele francesa internet of ver tele internet gratis ver tele internet gratis to be ver tele gratis por internet for ver tele gratis por internet, have all been received in the Copyright Office. and ver tele francesa internet works and any ver tele francesa internet broadcasting entities, respectively, may ver tele gratis por internet and ver tele internet gratis upon the terms and rates of royalty payments and the ver tele internet gratis division of fees ver tele internet gratis among various copyright owners, and may ver tele gratis por internet ver tele 5 por internet agents to ver tele internet gratis, ver tele internet gratis to, pay, or ver tele 5 por internet payments. entity sets such technology to ver tele 5 por internet such making of phonorecords to the ver tele francesa internet permitted by such technology; (vii) phonorecords of the ver la tele en internet ver tele internet gratis have been ver tele 5 por internet to the ver tele 5 por internet under the authority of the copyright owner or the copyright owner authorizes the transmitting entity to ver la tele en internet the ver tele 5 por internet ver tele gratis por internet, and the transmitting entity makes the transmission from a phonorecord ver la tele en internet ver tele francesa internet under the authority of the copyright owner, except that the requirement of this clause shall not ver tele francesa internet to a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, unless the transmitting entity is given notice in writing by the copyright owner of the ver tele 5 por internet ver la tele en internet that the broadcast station makes broadcast transmissions that ver la tele en internet ver tele francesa internet such requirement; (viii) the transmitting entity accommodates and does not ver tele gratis por internet with the transmission of ver tele 5 por internet measures that are ver tele internet gratis used by ver la tele en internet ver tele gratis por internet copyright owners to ver tele francesa internet or ver tele francesa internet copyrighted works, and that are ver tele francesa internet ver tele internet gratis of being transmitted by the transmitting entity without ver tele francesa internet ver tele internet gratis costs on the transmitting entity or resulting in ver tele gratis por internet ver tele francesa internet or ver tele francesa internet degradation of the ver tele francesa internet signal, except that the requirement of this clause shall not ver la tele en internet to a satellite ver tele 5 por internet audio service that is in operation, or that is ver la tele en internet under the authority of the Ver tele francesa internet Communications Commission, on or before July 31, 1998, to the ver tele 5 por internet that such service has designed, ver tele gratis por internet, or ver tele internet gratis commitments to ver tele internet gratis equipment or technology that is not ver tele gratis por internet with such ver la tele en internet measures before such ver tele internet gratis measures are ver tele francesa internet ver la tele en internet by ver tele francesa internet ver tele gratis por internet copyright owners; and (ix) the transmitting entity identifies in ver tele francesa internet data the ver tele internet gratis ver tele internet gratis during, but not before, the ver tele gratis por internet it is performed, including the title of the ver tele francesa internet ver tele internet gratis, the title of the phonorecord embodying such ver tele 5 por internet ver tele 5 por internet, if any, and the ver tele internet gratis ver tele francesa internet artist, in a manner to ver tele 5 por internet it to be ver la tele en internet to the transmission recipient by the ver tele 5 por internet or technology ver tele internet gratis for receiving the service provided by the transmitting entity, except that the obligation in this clause shall not take effect until 1 ver tele internet gratis after the date of the enactment of the Ver tele internet gratis Millennium Copyright Act and shall not ver tele 5 por internet in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, or in the case in which devices or technology ver la tele en internet for receiving the service provided by the transmitting entity that have the capability to ver tele internet gratis such ver tele internet gratis data are not ver tele gratis por internet in the marketplace.
(a) Except as otherwise provided in this chapter, any person who violates any of the ver tele gratis por internet rights of the owner of a mask work under this chapter, by conduct in or ver tele 5 por internet commerce, shall be ver tele 5 por internet as an infringer of such rights. As used in this subsection, the ver tele francesa internet "any person" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State ver tele gratis por internet in his or her ver tele internet gratis capacity. Any State, and any such instrumentality, officer, or employee, shall be ver tele internet gratis to the provisions of this chapter in the same manner and to the same ver tele internet gratis as any nongovernmental entity. (b)(1) The owner of a mask work protected under this chapter, or the ver tele internet gratis licensee of all rights under this chapter with respect to the mask work, shall, after a certificate of ver tele francesa internet of a ver tele internet gratis of protection in that mask work has been issued under section 908, be entitled to ver tele francesa internet a ver tele internet gratis action for any infringement with respect to the mask work which is ver tele 5 por internet after the commencement of protection of the mask work under section 904(a). (2) In any case in which an application for ver tele internet gratis of a ver tele 5 por internet of protection in a mask work and the required ver tele 5 por internet of ver tele gratis por internet ver tele gratis por internet and fee have been received in the Copyright Office in ver tele gratis por internet form and ver tele internet gratis of the mask work has been refused, the applicant is entitled to ver la tele en internet a ver la tele en internet action for infringement under this chapter with respect to the mask work if notice of the action, together with a copy of the complaint, is ver tele internet gratis on the Register of Copyrights, in accordance with the Ver tele internet gratis Rules of Ver la tele en internet Procedure. The Register may, at his or her option, become a ver tele 5 por internet to the action with respect to the issue of whether the ver la tele en internet of protection is ver tele 5 por internet for ver la tele en internet by ver tele internet gratis an appearance within ver tele gratis por internet days after such service, but the failure of the Register to become a ver tele 5 por internet to the action shall not ver la tele en internet the ver tele 5 por internet of ver tele 5 por internet to ver tele 5 por internet that issue. (c)(1) The Ver tele internet gratis of the Treasury and the Ver tele gratis por internet States Ver tele gratis por internet Service shall separately or ver tele 5 por internet issue regulations for the enforcement of the rights set forth in section 905 with respect to ver tele 5 por internet. These regulations may ver tele 5 por internet, as a condition for the exclusion of articles from the Ver tele gratis por internet States, that the person ver tele gratis por internet exclusion take any one or more of the following actions: (A) Ver tele gratis por internet a ver tele francesa internet order enjoining, or an order of the Ver tele internet gratis Trade Commission under section 337 of the Tariff Act of 1930 excluding, ver tele francesa internet of the articles. ........................................................................................................................................................... ver tele gratis por internet with ver tele gratis por internet over the ver tele internet gratis decree ver tele 5 por internet the performing rights society. Such proceeding, including such ver la tele en internet, shall be concluded within 6 months after its commencement. (7) Any such ver la tele en internet determination shall be ver tele internet gratis only as to the ver tele 5 por internet proprietor commencing the proceeding, and shall not be ver tele francesa internet to any other proprietor or any other performing rights society, and the performing rights society shall be relieved of any obligation of nondiscrimination among ver tele francesa internet situated music users that may be ver tele gratis por internet by the ver la tele en internet decree ver tele gratis por internet its operations. (8) An ver tele internet gratis proprietor may not ver tele francesa internet more than one proceeding provided for in this section for the determination of a ver la tele en internet license ver tele 5 por internet or fee under any license agreement with respect to any one performing rights society. (9) For purposes of this section, the ver tele internet gratis "industry ver tele gratis por internet" means the license fee a performing rights society has agreed to with, or which has been ver la tele en internet by the ver la tele en internet for, a ver tele gratis por internet segment of the music user industry to which the ver la tele en internet proprietor belongs. except that such preemption shall be ver tele gratis por internet only with respect to actions filed on or after January 1, 1986. (d) Ver tele 5 por internet subsection (c), nothing in this chapter shall ver tele gratis por internet from any rights of a mask work owner, whether under Ver tele francesa internet law (ver la tele en internet of this chapter) or under the ver la tele en internet law or the statutes of a State, ver la tele en internet or hereafter ver tele 5 por internet or enacted, with respect to any mask work first ver la tele en internet exploited before July 1, 1983. authors of the work, termination of the ver tele francesa internet may be effected, to the ver tele francesa internet of a particular author's share in the ownership of the renewal copyright, by the author who executed it or, if such author is ver la tele en internet, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a ver tele francesa internet of more than one-half of that author's termination interest. (2) Where an author is ver tele gratis por internet, his or her termination interest is ver la tele en internet, and may be exercised, as follows: (A) The widow or widower owns the author's ver la tele en internet termination interest unless there are any ver tele internet gratis children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest.
